1) I was injured by an Uber driver? Is that significant?

Uber now requires its drivers to have “ride share” commercial auto liability insurance. Lyft drivers may also have such insurance. Ride share insurance coverage only applies to crashes that happen while the ride-share app is on. The driver’s personal insurance still applies when the driver to going to and from her residence and waiting to pick up a ride. This can result in situations where the ride share driver is underinsured as Oregon only requires $25k per person coverage on individual auto policies.

TIP: If you use Uber or Lyft, be sure to purchase ample “under insurance” to protect you in the event an at fault ride share driver does not have enough auto liability insurance.
